Directive 2010/31/EU of May 19, 2010, on the energy performance of buildings, which repeals Directive 2002/91/EC, makes it mandatory to issue an energy performance certificate for buildings or units thereof that are constructed, sold or rented out.

This Directive is currently in the process of being transposed by means of a Royal Decree that will regulate the energy certification of existing buildings.
Correction of errors of Royal Decree 235/2013..
The Ministries of Industry, Energy and Tourism and of Public Works, as responsible for this transposition, have instructed the Institute for Energy Diversification and Saving (IDAE) to make available to the public computer programs for the energy efficiency rating of existing buildings, which are applicable throughout the national territory, and to develop a training and information plan for the sectors affected by the energy efficiency certification of existing buildings.

What is the energy certificate?
It is a document/report that contains the energy performance of a dwelling (individual or collective), commercial premises or tertiary building and rates it on a scale ranging from A (best energy performance to G (worst energy performance). It calculates the annual energy consumption necessary to satisfy the building's energy demand under normal operating and occupancy conditions.
It is therefore a comparative measure of the home's energy bill.
All housing or premises offered for sale or rent, among others, are required.
Why do I need an energy certificate?
The objective is to prioritize and promote the demand for energy efficient homes and buildings from the point of view of energy consumption (as is already being done with the energy label of household appliances), motivating reforms and adjustments in energy matters of the properties in order to make them more efficient and more attractive to potential buyers or tenants. It is intended that society assimilates that homes with better energy certificates will consume less energy and therefore will cause savings in monthly energy bills. This new panorama of more efficient homes will bring with it a reduction in energy consumption that will also benefit the environment.
If I am a real estate company?
Article 12 of the draft RD states that: "The label shall be included in any offer, promotion and advertising aimed at the sale or lease of the building or building unit. It shall always appear clearly and unequivocally on the label whether it refers to the energy performance certificate of the project or that of the finished building."
